Hi, 

In our website Terms and Conditions we say that, once the client click in accepting our Terms and Conditions when checking out, he accepts as well receiving email marketing from us. That´s legal in Spain.

The point is that just few people clicks the option of being suscribed to our email marketing. Most of our contacts are marked in Klaviyo as Never Suscribed, even they accepted our Terms and Conditions.

Is there any way to change the status from Never suscribed to Suscribed of all these contacts please?

If there is no possibility of doing that, How can I make all these new contacts go to a List where I could change the status?

In Klaviyo, changing the status of contacts from "Never Subscribed" to "Subscribed" directly is not permitted due to strict email marketing laws and best practices to prevent unsolicited emails. However, you can work around this issue by ensuring that new contacts who accept your Terms and Conditions are added to a specific list and properly opted-in for email marketing. Here are some steps and best practices to handle this:

  1. Custom Checkbox for Consent: Modify your checkout process to include a clear checkbox for email marketing consent that is required for checkout. Even though you mention it in the Terms and Conditions, having a separate checkbox might improve consent clarity and legal compliance.
  2. Automate List Addition: Not sure which ecommerce you are using but if you are using shopify, then use Klaviyo's integration with Shopify (or your e-commerce platform) to automatically add customers who accept the Terms and Conditions to a specific list.
  3. Flow to Confirm Subscription: Set up a flow in Klaviyo to send a confirmation email to customers who accepted the Terms and Conditions, asking them to confirm their subscription to your marketing emails. This double opt-in approach is often seen as a best practice.
