Competition entrants being pulled into accepts marketing list despite opting out

Hi There, I’m testing an embedded form I set up and when I tick the ‘no’ option for receiving marketing on my list when trying it out - my email address still goes into the accepts marketing segment.  I have the segmentation definition in the second screen shot below - can someone tell me what I'm doing wrong please?

My imported list won't link up with my accepts marketing segment

Hi There, I’m new to Klaviyo so apologies if I’m missing something here, I’ve received a full list of email addresses that have opted into receive marketing. I’ve uploaded them to a list but they haven’t been pulled into my accepts marketing segment.  The segmentation of my ‘accepts marketing’ list is below can someone point out what I'm doing wrong please?
