I have a pop up form from which I have set up silent custom properties.
However some new profiles have custom properties and for others the custom properties fields are empty.
I would appreciate your thoughts.

How are you confirming that both profiles, those with and without, have done the action ie filled out the form to have this custom property added to their profile? Do you mind sharing what custom property they should have to their profile?

I have created a segment with property of consent form id = SDgW8J and with one of the silent custom properties ‘Brand’ = not set
In this pop up there are three silent properties ; ‘Brand’, ‘Type’ and ‘glasses or sunglasses’
The pop up will only appear on product pages and therefore should be able to pass both Brand and Type.
