How to ask CONSENT on FORM

Question

So I have multiple forms on my website. I want users who submit the form to have an option to opt in or opt out of email marketing.

If they opt in, then they will be added to EMAIL MARKETING - YES list.
If they do not select anything or select no, then NOTHING should happen. Their previous profile property or YES or NO should stay the same.
If they select no, then NOTHING should happen. Their previous profile property or YES or NO should stay the same.

How do I add that to my forms?
