Profile has never subscribedSegment set to collect profiles that cannot receive email marketing.Here’s a screenshot of the profiles current lists and segments. Profile is not added to Cannot receive email marketing segment.
In Klaviyo, there are technically 3 categories of profiles:
1. Subscribed - these have a green checkmark next to the email address in their pofile 2. Never subscribed, but provided email address (when creating an account or purchasing) - these have a yellow triangle next to the email address in their profile, as in your screen shot above 3. Suppressed (includes unsubscribed, hard bounces, invalid email addresses, etc.) - these have a red exclamation point next to the email address in their profile
Here is a screenshot of the options for can receive/cannot receive email marketing, cannot receive only includes profiles that have been suppressed; therefore, Subscribed and Never Subscribed are included in the can receive option
To make sure you exclude customers who have provided an email but did not subscribe, my suggestion is to add a condition to segments that you want to contact: Can receive email marketing because person subscribed:

It seems the issue might be with the segment criteria not accurately capturing profiles that have never subscribed. Please review the segment's filters to ensure they include conditions for profiles with "email marketing status: unsubscribed" or similar criteria.

Profiles in "Engaged X Days" segments may end up receiving emails if the segment is not filtering based on the subscription status. For example:
The "Engaged X Days" segment may include profiles based solely on engagement metrics, such as opening emails or clicking links, without checking their opt-in status.
If you send a campaign to this segment without excluding "Cannot receive marketing," those profiles may inadvertently receive marketing emails.
