Consent Custom Property Not working

Our client has a requirement where they need to send consent data to a third party.

We have a segment that uses the “properties about someone”. The property we use is “$consent” and from the documentation here https://help.klaviyo.com/hc/en-us/articles/360043841811-How-to-upload-and-segment-with-consent, we used “ $consent , contains, email”. However, the profiles it is finding are not correct. The profile have the read cross to not receive marketing emails.

Why is this occuring?

Welcome to the forum. Can you share a screenshot of your segment configuration?

I suggest to also take a look at this: https://help.klaviyo.com/hc/en-us/articles/115005246968-Understanding-active-email-profiles-in-Klaviyo

If you look at those profiles which have the red X can you check in the timeline on the left if they've unsubscribed at any time?

Maybe it might help to also add if someone in in or not in a list and add the is not suppressed for email filter rather than using the $consent option.
